The Process

The steps for successfully applying for a K-1 visa require paying close attention to detail and timelines. The process begins with petition, Petition for Relative or Fiancé(e). The approved petition is then forwarded to the embassy in your fiancé(e)'s country. Generally, your fiancé(e) interview is handled within nine months.

Don't Assume Your Fiance Petition Will Be Automatically Approved

It is critical that your fiancé(e) visa petition is filled out completely and accurately and all supporting documents be in place. Your fiancé(e)'s criminal record, health history and other factors will be investigated. Any red flags can result in a denial.

Upon approval by the local consular office, your fiancé(e) will receive a letter from the consulate listing the steps to be taken prior to the interview for the fiancé(e). There are very strict requirements for submitting all necessary documents for eligibility, including:

  • Valid passport
  • Certificate of divorce or death of previous spouse, if applicable
  • Record of addresses since age 16
  • Certificate of health from a consulate-designated doctor
